Dismissed and invisible: this chapter proposes that discrimination against older women is often dismissed and inadequately protected by human rights law rendering the experiences of these older women invisible. Within Europe, both the legislation and the judicial decisions of regional bodies fail to adequately protect older women from such discrimination. Whether this arises from piecemeal legislative protections or a myriad of limitations and exceptions within existing legislation, or from a failure of the regional courts to adequately assess cumulative disadvantage (either from multiple or intersectional discrimination), the impact is the same. Age is de-prioritised as a ground of discrimination reducing the ability of the law to effectively tackle age discrimination and older women are not adequately compensated for the discrimination they have experienced. It is recommended that improved age discrimination standards are introduced at an EU level and this this should include protection against both multiple and intersectional discrimination.
