In this chapter, Anne Hellum explores the actual and potential ability of the Committee on the Elimination of Discrimination against Women (CEDAW Committee) to hold states accountable to their obligations under the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) – obligations to promote substantive gender equality through gender-sensitive national laws which eliminate direct, indirect and structural discrimination against women. Hellum considers how CEDAW’s standards are developed and explores the potential and limitations of the CEDAW Committee’s work in holding states accountable for developing more gender-responsive domestic legislation in four thematic areas: CEDAW’s core obligations (the equality and anti-discrimination principle), gender violence, reproductive rights and economic rights. With a focus on how the Committee handles the relationship between civil, political, social and economic rights, Hellum concludes that the goal of promoting substantive gender equality means that women’s economic rights need to be given more attention – by the CEDAW Committee, by women’s rights scholars and by women’s rights organisations. | |
